Release of Liability and Waiver

 

The Annual Release of Liability and Waiver is required for Members and Guests to Participate in The Club’s Events.

 

Safety

For my safety and that of others, I agree to abide by the rules of The Club at Westpoint, and all applicable local, state, federal, maritime laws, the policies of Westpoint Harbor, and those of US Sailing as may be in force at any time during my participation in events at The Club at Westpoint. I am aware that water sports are a hazardous activity and may involve contact with considerable force including but not limited to, contact with watercraft and/or other boating participants. Further, I acknowledge that there is a risk of severe, permanent, physical injury including, but not limited to, drowning and/or death. For myself, and on behalf of my heirs, assigns and next of kin, I willingly and voluntarily accept and assume all such risks of participation.

Physical Condition

I understand that participation in events may be physically demanding, and I shouldn’t participate unless I’m medically able to do so. I understand that I’m responsible for knowing my physical condition and am making my own decisions about participation. I confirm that I’m in adequate physical condition to participate. If at any time I feel unable to continue to participate, I shall stop.

Understandings

I understand that participation in the events has risks that may arise from my actions or the actions of The Club at Westpoint, other participants, or others present at the site. These may arise from the risk inherent to physical exertion, including bodily injury or death, from conditions at the venue, including uneven terrain (waves), allergens, insects, dust, noise, lack of lighting, weather, use of equipment, and unforeseen acts of third parties. I understand that The Club at Westpoint doesn’t provide security at the venue, and it doesn’t control the conduct of participants or others. I understand that participants or others may be consuming alcohol or using cannabis or other substances.

Awareness and Assumption of Risk

I confirm my understanding as stated above. With that information and awareness, I am knowingly participating in the events, and knowingly assume and accept the risks of all injury, illness, disease, death, property damage or loss, financial obligation, loss of privacy, and all other injuries and other consequences that may result, directly or indirectly, from my participation in the Friday Fun Series or my presence at or travel to the site, regardless of the cause.

Waiver and Release of Claims

I wave and release The Club at Westpoint and Westpoint Harbor, their directors, officers, agents, employees, volunteers, affiliates, and any sponsors of the events (collectively, “Released Parties”) from all liability, claims, cost, and damages of any kind which I or my heirs, next of kin or legal representatives may have or which may later accrue, resulting or arising directly or indirectly from (a) my participation in the events or presence at or travel to the site or (b) any first aid, transportation or medical care provided to me in connection with my participation. This release and waiver include, in each case, all claims concerning death, personal injury, illness, property damage, loss, financial obligation, or expenses, and in each case regardless of the cause or whether such claims arise from tort, contract, or otherwise, and even if caused by negligence whether passive or active. I agree not to sue any of the Released Parties based on these waived and released claims.

Medical Care Consent

I authorize The Club at Westpoint to provide me with first aid and to arrange medical assistance, transportation, and emergency medical services for me if I get hurt during my participation in the events. I have adequate health insurance to cover any injury if I get hurt. I shall pay for any cost related to my medical treatment and transport. 

Use of My Name and Image

The Club at Westpoint may take photos or videos of me during the events. I consent to the use by The Club at Westpoint of my image, voice, name, and/or story in any format to promote its programs or for any other purposes. I waive my right to inspect or approve the finished product or to receive any payment.

Indemnification

I shall defend, indemnify, and hold each Released Party harmless from and against any liability, loss, damages, claims, and attorney fees it may suffer resulting or arising directly or indirectly from my participation in the events, except and only to the extent the liability is caused by the gross negligence or willful misconduct of the relevant Released Party.

Information Collection

I consent to The Club at Westpoint collecting personal information from me and using it for planning, organizing, promoting, and conducting the events and for following up with me after my participation. I understand I may opt out of these communications.

Definition; Who Benefits

This Release and Waiver of Liability means all activities relating to events organized by The Club at Westpoint including, without limitation, being present at the site, traveling to and from the site, participating in events, and publicity by The Club at Westpoint. This Release and Waiver of Liability shall be legally binding not only on me but also on my heirs, next of kin, and legal representatives. I understand that the confirmations, assumptions, releases, waivers, and agreements I make in this Release and Waiver of Liability run in favor of, and may be enforced by each of the Released Parties.
